Martin began his landlord journey 30 years ago, while working in an international role for a global telecommunications company. Since retiring he has extended his portfolio, which he manages with his wife, but has always focussed on the ‘small student HMO’ sector preferring to offer homes in the community for small groups to the more common ‘pack them in and take the money’ mentality. He has chaired the PDPLA for the past 12 years and has overseen the Associations transition from small local self-help group to a much larger and more professional institution which is recognised and listened to nationally. Alongside his PDPLA role, he also has leadership roles in a number of other local organisations – bringing his unique perspective, driving for change and increased use of technology while respecting the history that brought us here.

New Electrical Regulations for Landlords

New regulations will soon come into force requiring landlords of all property types to have a current electrical certificate but as seems unfortunately normal of late, the precise requirement, any exemptions and the timing is not yet clear. As a result, there may be a rush as July approaches…

Landlords Continue To Help The Homeless

PDPLA members have raised nearly £2,000 over the past 2 Christmas’, all of which has been donated to the Society of St James to help the local homeless. How Small Is Too Small?

We have many members who are unhappy with PCC’s rules on communal space in HMO’s – the rules seem to have grown over the past 10 years in an attempt to provide a basis to reject HMO’s which are seen as ‘too densely developed’ by councillors and local residents. We are now at a point where PCC ask for more communal space than any other council in the country (and in many cases, 2 or 3 times more than most councils).

It was thus somewhere between shock and amusement that we heard PCC had lost a case where they tried to stop a very small flat from being let.

New Energy & Water Strategy for Portsmouth Homes

Portsmouth is consulting on a draft strategy - 'Energy and water at home - a strategy for efficiency and affordability for every household in Portsmouth'.  It looks at how the council can work with others to make homes more energy and water efficient and ensure residents can afford their bills - as we own 1 in 4 of the houses in the city, we will be most affected, so do make time to think about how you will make your properties more energy and water efficient and what help you need, then complete the questionnaire - because if you say nothing, you have no reason to complain if in 2 or 3 years time you are faced with significant bills to bring a property up to a new standard or have to replace or upgrade something you only just invested in.

The strategy is pervasive - obvious things like insulation and reduced water usage but also more futuristic options to get us to near zero carbon status, such as time of day energy tariffs and micro-anaerobic digesters - so do read the summary or attend a meeting if nothing else.

Who Needs A UTR Number Anyway?

A Unique Taxpayer Reference (UTR) number is required by all sole traders, partnerships and limited companies in the UK. It’s unique to that individual or organisation and remains unchanged forever.

You will also need a UTR if you have other forms of income or expenses that require you to file a Self-Assessment tax return.

If you don’t have a UTR, you won’t be able to submit a Self-Assessment tax return, plus, you may open yourself up to heavy penalties.

So, to help reiterate the importance of UTR numbers and how to correctly acquire your own, we’ve asked Mike Parkes from GoSimpleTax to shed some light on their role in tax return submissions.

Landlord & Tenant Survey - What Do You Think?

In support of the new strategy for the Private Rented Sector which may justify Selective Licensing for all landlords in the city - Portsmouth City Council are asking for your views and those of your tenants. It is simple, two page survey (for landlords, slightly more for tenants) and we worry that unless enough people make their views clear, too small a sample may lead to conclusions we are not happy with in the months ahead. Is it time for Property MoT's?

At our November member meeting we had a short discussion on the use of Property MoT’s. Is it yet more bureaucracy or might they be useful? It is interesting that the Labour manifesto proposes to mandate Property MoT’s – could this be one area where local landlords agree with an aspect of the Labour Party housing policy?

We actually suggest that we may need to go further and should be thinking about offering Tenancy MoT’s…

Landlord Licensing - Alwin Visits The Dark Side

After the October PDPLA meeting, I attended the Full Council meeting of Portsmouth City Council and subsequently the Housing Cabinet meeting on 21 October to oppose proposals put forward by Cllr Cal Corkery to introduce selective licensing for all rented properties in the city.

King Canute Wins! - Three more licensing schemes fail

There was a time when every major town introduced licensing schemes to control some perceived problem in the private rented sector, Portsmouth introduced Additional Licensing in 2013 to solve ‘problems’ with HMO’s in the south of the city for example.  Now those schemes have come to an end, various councils have tried and failed to introduce follow on or different schemes and many are failing to get the necessary approvals – Brighton, Stoke and Hounslow are the 3 examples we look at here…

Updated 'Right To Rent' Information from the Home Office

The Home Office have updated their guidance to landlords on how to perform checks for nationals of of Australia, Canada, Japan, New Zealand, Singapore, South Korea and the USA who have entered the UK through eGates and do not have an endorsement in their passport to evidence leave to enter the UK.

Section 21 Reform - PDPLA Case Studies

Whilst the Tory pledge to get rid of Section 21 does not appear likely to be implemented anytime soon, we still worry as both Labour and the LibDems have similar policies. To that end, we have been actively collecting data and participating in consultation activities - for example, this month PDPLA Vice Chairman, Alwin Oliver, submitted a collection of case studies and suggested alternatives such as a new Housing Court styled on the Canadian solution - PDPLA members can see it here in the members area.  Highlights follow…

Stanhope House - still unfinished but a 'nice little earner'

Committee member, Jonie Goldenberg had the following thoughtful piece published in the Portsmouth News this month:  "The Corporate Landlords do a hard sell - and I am not surprised at £200 per week per room for student accommodation equating to £10,200 per unit for the 51 weeks in the 256 unit high rise, earning in the region of £2,600,000 per annum for the company Prime Student Living. Multiply that by the number of new Halls that have been built. 'A nice little earner'. By a company who has not come up with the goods on time and sees fit to axe students' contracts without a thought of the associated problems faced by many first year students and their families. They will think twice about coming back to Portsmouth University. This is also not the first year this has happened."

Making Tax Digital (MTD) Still Some Way Off

Whilst HMRC are making positive noises about the progress of MTD, those businesses which pay VAT had to start submitting quarterly returns this year.  Of the one million businesses affected, nearly one quarter missed the August 7th deadline to submit their 1st return.

How Do You Spot A Rogue Landlord?

With so much demonization of landlords in the press and new regulations and standards being imposed almost daily - you would think rogue landlords had been publicised and regulated out of existence, but we would argue that politicians and journalists are focussing all of their efforts on the wrong landlords, which is why they are not seeing any improvements. Do We Need Tenant & Landlord Blacklists?

We were interested to see BBC coverage of a new website which allows tenants to rate and review their landlord. The site

https://www.marksoutoftenancy.com/ has all the disadvantages of other ratings sites and probably does little to allow customers/providers to make better informed choices. What is also missing is the ability to 'rate and review" tenants.

PCC Reduces Occupancy Levels

We have a number of members who are very concerned that conditions are being placed on HMO licences and occupancy numbers are being reduced. There are many 5 bed properties applying for the Mandatory HMO Licence that they need which are being given a 1-year licence on condition they are reduced to 4 bed HMO"s after that - we are told by a PCC employee that this has happened to at least 130 properties in the city - easy money for PCC as they take the licence fee and then change the house such that it does not need a licence. These conditions do not apply elsewhere and this is forcing up rents in Portsmouth in relation to neighbouring areas. It is also leaving rooms empty at a time of housing crisis.

News From The Big City

Tony stood in for Alwin as our representative on the Fair Possessions Coalition last Friday. Did he not know there was going to be a train strike? Fortunately, the  prospect of a strike had put off regular travellers and the journey was a joy. Anyway, with research showing that 84% of Section 21 repossessions are due to tenant arrears, most of the preconceptions about the need to abolish Section 21 seem to be misplaced. RLA & NLA To Merge

Last week the RLA and the NLA announced that the 2 organisations are to unite to create a single organisation.  As a local organisation looking to both organisations in the past for national representation - the new organisation, to be called the National Residential Landlords Association (NRLA) looks compelling.  Combined they will have a single voice when representing us and they will have 80,000 members who own and manage half a million properties.

Legal Insurance For Landlords

All PDPLA members are also members of the RLA and therefore benefit from the tax protection insurance that they have in place for all members.

Fair Possessions Coalition Discuss Licensing

While PDPLA Committee member, Tony Athill, was in London at the Fair Possessions Coalition meeting hosted by the RLA he took the opportunity to discuss Licensing.

It was agreed that landlord representatives need to demonstrate how licensing schemes are not a cure all that will rid the sector of ill-informed and criminal landlords. The representative from ARLA (agents association) is also a Local Councillor and he supported the PDPLA view that we need to educate our local politicians. We have a plan. …….

Nitrates Concerns Stop New Developments

There was much discussion at our July meeting about the Natural England concerns about new residential development in the Solent area being likely to increase nitrates in the harbours and thus harm wildlife. As a result, almost all new developments are being refused planning permission for fear of prosecution for breaching the Natural England guidance. As mentioned then, we were represented at a meeting with the council to discuss options and have subsequently been copied on a number of documents explaining the situation, sent from PCC to the Secretary of State.

Selective Licensing Not Debated By PCC

Before Brexit and Donald Trump, there was a belief in the Western world that politicians strived to do the right thing and made decisions in line with their manifesto to improve the lot of their constituents. That all changed in 2010, when no party won a majority of the seats in Parliament and left with a coalition, the workings of government suddenly became clear.

Licensing Appeals Update

As reported at our July member meeting, the PDPLA supported a number of members with appeals against licensing decisions of PCC.  These properties were all approved for HMO licences under Bruce Lomax's regime but rejected when they requested the same approval for the same number of people under the new Mandatory Licensing regime.

We won appeals on 3 topics, but lost on one and unfortunately that was the one topic with the most cases.

After losing so many appeals because they rejected applications for HMO's which met the conditions in Portsmouths  existing HMO SPD (Strategic Planning Document), the team at PCC are trying to rewrite the rules to give them grounds to reject more of the HMO applications which come before them.

Rents Increase As A Result Of The "Tenant Fees Ban"

There was an article in the Guardian suggesting that landlords are being urged to increase rents by their letting agents in order to make up the shortfall in the letting agents income due to the Tenant Fees Ban and we were asked by Cllr. Sanders (PCC) whether we have seen evidence of this locally.

Shelter Report Needs More Work

This article is copied from the RLA news this month in case you missed it - 

The RLA believe that Shelter"s claims over the impact of changes affecting the private rental sector in Scotland are misleading.

Scotland has recently abolished so called 'no-fault" evictions and fixed term tenancies, as well as banning fees and introducing rent controls.

In a report out this month Shelter concludes these changes have been a success - and have not had a profoundly negative impact on the PRS north of the border.

However, the RLA has a number of issues with the report.

PDPLA Member Adds New Supplier

The recommended suppliers list in the members area of the PDPLA website just added a new cleaning company, recommended by PDPLA member Kiera Lea. The company is Eldraw Cleaning and they cover south hampshire providing both domestic and commercial cleaning services.

Beware Of Landlord Surveys

It is common across all industries, but the practice of conducting a survey and then publicising the results seems to be the bane of landlords across the country. Wherever we look there is a new survey telling us, and others, what we do or don"t know, whether we are buying or selling - in fact everything except (and I may be wrong), what the typical landlord eats for breakfast. (If you want to answer that one, come along to our next Landlords Breakfast).

The bad news is that the majority of these articles and surveys are just plain wrong. Not just 'bad science" but 'bad journalism too". Let me explain….

Peer to peer lender, Lendy, in administration

Portsmouth based peer-to peer (P2P) lending platform, Lendy, which lends money to property developers has collapsed after intervention from the Financial Conduct Authority. Lendy was setup in 2013 and was one of the bigger P2P property lenders with around 22,000 investors tempted by advertised returns of up to 12% and assurances that they could hand over money with "complete peace of mind".

This is a blow for the city - we create too few new jobs as it is, especially in the high growth areas where the UK has a lead such as FinTech, AI, etc. but unfortunately, it would appear this promising star was badly managed and has paid the price.

HMO Licensing Appeals – Thoughts On The Judiciary

Having won our 1st appeal (over an adequately sized room that PCC believed to be too small) last month, this month the next 7 cases came to court. We hope the decision of the 2 judges will be available in the next few weeks and when it is, we will share it.

In the interim, some observations and recommendations for all concerned.

What A Load Of Rubbish

As we move into June, those of us with student tenants know that in the coming days and weeks, exams will finish, leaving drinks will be imbibed and then in the 4-5 hours before moving out, our tenants will attempt to clean the house and to clear their stuff out. Historically this has led to piles of bin bags for the dustmen to collect, often several days before they are due and much complaint to local councillors on the matter from local residents. (OK, most tenants are better than this - but it only takes a few...)

 This year is going to be harder - firstly, we have new black bins, once they are full, that is it, nothing else will be collected. Secondly, local councillors are really keen to avoid the problem rather than hear about it on the doorsteps as they talk to their constituents.  So, what can you do?

Half of landlords more likely to sell over Section 21 plan

Hopefully members saw this article when the RLA published it this month, but if you did not, the RLA's biggest ever survey of more than 6,500 landlords revealed more than 46% plan to sell and another 40% are waiting to hear more details of planned changes before they make decisions on their ability to provide homes to rent. We know many of our members participated in this survey, and the results fit with our anecdotal experience  - thank you for participating.

Education For Local Landlords

If you are a local landlord, we encourage you to attend some of the training courses we have scheduled this year - many of us became landlords as an investment but those of us who have been doing it for a while will have realised that you either outsource everything to an agent or you treat it as a profession and for that, you need training.

(And even if you outsource, you are still legally responsible for the actions of your agent - so if you are better educated, you can better judge whether the agent is doing what the law requires he/she do for you).

You may have seen the articles in The News this month summarising the dismay (and often unfounded and ill-advised ranting) of those on the Portsmouth Planning committee as HMO"s have been allowed on appeal after the Planning Committee went against the advice of planning officers employed by the council and rejected applications for HMO developments that met all of Portsmouth"s very stringent local rules….

Portsmouth Developing Homelessness Strategy

The consultation on Portsmouth"s proposed Homelessness Strategy ended this week - there were some issues as the email address for responses does not exist, but hopefully all those who wished to participate found alternative contact details.

PCC told their licence condition “would be a waste of time, effort and money”

In the first of the current string of appeals against PCC licensing decisions to come before a Tribunal, PDPLA member Lucy Fryer has won her appeal against PCC"s judgement on what constitutes a small room.

The legal requirement for a bedroom in an HMO is that it be at least 6.51 sq m. That is small, but subject to layout and furnishings it can be quite acceptable and it avoids wasting the small bedroom that was added to many Portsmouth houses when they were built in the 1920"s and 30"s.  They are popular, as landlords tend to offer them much more cheaply than larger rooms and when living with a group of friends, having a small room and low rent, but still having access to the rest of the house is often seen as a very desirable solution.

The room in question was larger than required, it had a sloping ceiling, two Velux windows and ensuite facilities. The Council wanted the latter removed. The Tribunal decided this "would be a waste of time, effort and money which would not serve any statutory purpose."

We have at least 7 more appeals coming up starting on the 8th May and will update on those in the next newsletter.

PDPLA Support Parliament 'Healthy Homes & Buildings' Group

The PDPLA has input to discussions by the APPG (All Party Parliamentary Group) who have been looking at the impact that poor housing has on health.  We have long argued that HHSRS is not fit for purpose - allowing council officers across the country to 'appear to be doing something useful' whilst in reality, having little impact on health or safety.

We are hopeful that this APPG will come up with something better. Read on for an interesting graphic of their findings so far including details of the £2.5Bn cost to the NHS of poor housing and the £18Bn social and economic cost.

Is Being A Landlord All About Tax?

The answer is obviously, no - tax is periphery and everyone pays it, so while you should take care to only pay what is due and not overpay, happy tenants, safe houses and stable finances are more important.

If only it were that easy though. Britain's 'tax code' which defines which taxes are due, runs to 17,000 pages - the longest in the world  (the average bible is 1,200 pages, Lord of The Rings (all 3 books) is about the same). So in a way, it is not surprising the average landlord seems to spend far too much of their time trying to work out how much tax they need to pay. It also explains why there are 200,000 working accountants in this country - just think of all the useful things 200,000 people could do if they were not wasting their working lives worrying about other peoples taxes...

There follows a summary of current tax changes from the Federation of Small Businesses, a link to one of HMRC's webinars (which are well worth attending as the 'onscreen chat' gets you answers to specific questions far quicker than their telephone helpline) and a reminder of our forthcoming PDPLA tax education sessions running through May and June - do make sure you book your place.

Section 21 To End, What Comes Next?

The government have been swayed by pressure from Shelter and others and have decided to stop landlords regaining possession of their property using Section 21 notices. What will replace it is unclear and there will be consultations before anything is finalised, but you can rest assured that the PDPLA will be articulating the impact upon its members of any of the proposed alternatives.

We received extensive coverage in The News when our Vice-Chair, Alwin Oliver focussed on the fact that currently, many mortgage lenders depend on the availability of the Section 21 when offering finance and one unexpected outcome could be that mortgage cover requirements could rise considerably, making funding much harder to acquire.

Don't Use Your Pension To Buy A House

We know many of our members do not trust banks or financial institutions and attempt to fund their pensions by buying and letting property.  This may make sense, but with increasing regulation and also, the high cost of maintaining property to a good standard and the significant overhead of either managing your tenants or paying someone else to do so, sometimes we wonder whether it is worth it.

HMO 'Private Data' Public Again!

After our successful campaign over 3 or 4 years, in 2016 Portsmouth City Council finally agreed to stop sharing the names and addresses of HMO landlords. We had hoped that the introduction of GDPR last year would cement our right to privacy and control of our personal data but unfortunately, this has not been the case and PCC have reversed their position and are now sharing our details with all and sundry.
