Forms Available Supporting Tenant Fee Ban
Thanks to local solicitor and PDPLA member John Saulet for sharing links to the government forms to be used in relation to the tenant fee ban introduced on June 1st and reported here previously.
The Tenant Fees Act 2019 (TFA 2019) came into force in England on 1 June 2019. The TFA 2019 restricts the type, and amount, of payments that landlords and letting agents can require from tenants of most assured shorthold tenancies (ASTs), student accommodation and under licences to occupy.
The government has published the following forms for use under the TFA 2019:
- Form TFA1: Application for recovery of all or part of a prohibited payment or holding deposit.
- Form TFA2: Appeal against a financial penalty where section 1 or 2 or Schedule 2 of the Tenant Fees Act 2019 has been breached.
The government has also published Guidance on applications made under the Tenant Fees Act 2019 (TFA3), which explains the process of making an application or an appeal under the TFA 2019.
