Good news for local landlords from our friends at TP Expert today, who have just heard that one of their planning appeals has confirmed that HMO's do have permitted development rights (as many councils have sought to restrict or remove them from HMO's as part of their attempts to control and limit the spread and size of HMO's).
Jonathan McDermott, Principal Town Planner at TP Expert said, "We won the Planning Appeal win at 8 Grosvenor Gardens Portswood. The inspector ruled that HMO"s have Permitted Development Rights and that the removal of such rights is inappropriate where council"s are seeking to control the number of residents within the building."
He added that the inspector opines that the HMO use class already provides that control. Planning permission by Prior Notification allowed for the construction of an enlarged extension to the rear of N0.98 Harefield Road Southampton. Council consider that the enhanced permitted development rights allowing a 6m extension CAN be applied to an existing HMO.
Jonathan said, "These decisions are both important as they now set the policy for Southampton City Council and put an end to the presumption that HMO"s do not carry permitted development rights. They demonstrate that the advice of TPX and the Inspectorate in this matter is being heard and given full weight. It is hoped that the South Coasts other Article(4) property will now adhere to these decisions and reverse its policy."
